5. Eligibility

To use the Services, you must meet the following criteria:

6. Account Creation and Security

  • Account Registration: To use certain features of the Services, you may be required to create an account on the Website. You agree to provide accurate, complete, and current information during the registration process.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to immediately notify us of any unauthorized use of your account or any security breach.

7. Escrow Transactions and Agreements

When engaging in an escrow transaction through SwipeVault, the following conditions apply:

  • Escrow Funds: You agree to deposit funds or assets into the designated escrow account, which will be held securely until the agreed-upon conditions of the transaction are satisfied.
  • Authorization: You authorize SwipeVault to act as the neutral third party to hold and disburse funds or assets according to the instructions provided by you and the other parties involved.
  • Transaction Completion: The transaction is considered complete when all terms of the escrow agreement have been met, and funds or assets are disbursed to the appropriate parties.

8. Fees and Payment Terms

  • Escrow Fees: SwipeVault charges fees for escrow services, which will be disclosed upfront in the escrow agreement. The fees may vary depending on the size, complexity, and nature of the transaction.
  • Fee Structure: Fees are typically calculated as a percentage of the escrowed amount, a flat fee, or based on other factors such as document verification or dispute resolution services. Specific fees will be outlined at the time of transaction initiation.
  • Payment Methods: Payments to fund escrow accounts must be made via secure, traceable methods such as bank wire transfers, ACH payments, or certified checks. We do not accept cryptocurrency, third-party payments, or cash.
  • Refunds: If the escrow transaction is canceled before any funds have been disbursed, a partial refund of the escrow fee may be issued depending on the terms of the escrow agreement. Once funds have been disbursed, fees are non-refundable.
  • Late Payments: If there is a delay in funding the escrow account, the transaction may be delayed, and we will notify all parties involved. Failure to fund an escrow account within the agreed timeframe may result in the cancellation of the agreement.

9. Client Responsibilities

As a client of SwipeVault, you are responsible for:

  • Accurate Information: Providing accurate, truthful, and complete information during the escrow process. This includes identity verification, transaction details, and payment instructions.
  • Transaction Terms: Clearly outlining and agreeing to the terms of the transaction, including payment amounts, deadlines, and conditions for the release of funds or assets.
  • Compliance: Ensuring compliance with all applicable laws and regulations regarding the transaction, including anti-money laundering (AML) and tax regulations.
  • Notification of Issues: Promptly notifying us of any issues or concerns related to the transaction, including potential disputes or discrepancies in the terms of the escrow agreement.

10. Prohibited Activities

You agree not to engage in any of the following activities while using SwipeVault’s services:

  • Fraudulent Transactions: Engaging in any fraudulent activity, including but not limited to providing false information, misrepresenting transaction details, or attempting to manipulate the escrow process.
  • Illegal Transactions: Using the Services for any illegal activities, including money laundering, financing terrorism, or any activity prohibited under applicable laws.
  • Unauthorized Access: Attempting to gain unauthorized access to SwipeVault’s systems, accounts, or data.
  • Disrupting Services: Interfering with or disrupting the operation of the Website or the Services, including the use of viruses, malware, or other malicious software.

11. Privacy and Data Protection
